A presentation from the 2008 Individual and Small Group Health Insurance Underwriting Seminar. This panel discussion will focus on routine claim reviews and the process to identify potential pre–ex and misrepresentation and the steps to take to mitigate financial burden of litigation when these investigations result in backend reformations or rescissions. We will also address who needs to be involved with medical health reviews when claims are denied due to misrepresentation. How do we as an industry protect our block of business to assure rate stability in the market and yet, overcome the negative scrutiny of backend decisions associated with pre–ex and misrepresentation? What will be acceptable to DOI's relative to this practice in the individual and small group markets in the future? There is serious need to specifically address the challenges inherent in these processes and this is the forum to examine hard data on existing success strategies.
